APNewsBreak: 22 states join campaign finance fight

HELENA, Mont. (AP) -- Twenty-two states and the District of Columbia are backing Montana in its fight to prevent the U.S. Supreme Court's 2010 Citizens United decision from being used to strike down state laws restricting corporate campaign spending.

The states led by New York are asking the high court to preserve Montana's state-level regulations on corporate political expenditures, according to a copy of a brief written by New York's attorney general's office and obtained by The Associated Press. The brief will be publicly released Monday.

The Supreme Court is being asked to reverse a state court's decision to uphold the Montana law. Virginia-based American Tradition Partnership is asking the nation's high court to rule without a hearing because the group says the state law conflicts directly with the Citizens United decision that removed the federal ban on corporate campaign spending.

The Supreme Court has blocked the Montana law until it can look at the case.

The Montana case has prompted critics to hope the court will reverse itself on the controversial Citizens United ruling. The 22 states and D.C. say the Montana law is sharply different from the federal issues in the Citizens United case, so the ruling shouldn't apply to Montana's or other state laws regulating corporate campaign spending.

But the states also said they would support a Supreme Court decision to reconsider portions of the Citizens United ruling either in a future case or in the Montana case, if the justices decide to take it on.

Legal observers say don't count on the Supreme Court reconsidering its decision.

"It is highly unlikely that the Court would reverse its decision in Citizens United," said law professor Richard L. Hasen of the University of California-Irvine.

At best, the court would listen to arguments and might agree a clarification is needed to allow the Montana law to stand. But even that is a long shot, Hasen said.

Montana Attorney General Steve Bullock argues that political corruption in the Copper King era led to the state ban on corporate campaign spending. A clarification of Citizens United is needed to make clear that states can block certain political spending in the interest of limiting corruption, he said.

American Tradition Partnership argues that the state bans unfairly restrict the ability of corporations to engage in the political process that also affects them.

Bullock wrote in a brief to be released Monday that the state does not "ban" corporate political speech, rather, it regulates that speech by requiring the formation of political action committees.

The Democrat, who is running for governor, said the upstart political corporations hoping to take advantage of unfettered spending are merely "an anonymous conduit of unaccountable campaign spending."

Montana and the other states are asking the court to either let the Montana Supreme Court decision stand or to hold a full hearing. They argue laws like the one in Montana that bans political spending straight from corporate treasuries are needed to prevent corruption.

The other states, many with their own type of restrictions hanging in the balance, argue local restrictions are far different than the federal ban the court decided unconstitutionally restricted free speech. Further, state elections are at much greater risk than federal elections of being dominated by corporate money, requiring tailored regulation, the states' court filing says.

"The federal law struck down in Citizens United applied only to elections for President and U.S. Congress," New York Attorney General Eric Schneiderman wrote on behalf of the states. "By contrast, Montana's law applies to a wide range of state and local offices, including judgeships and law enforcement positions such as sheriff and county prosecutor."

The joining states, unlike Montana, ask the court to go further and reconsider core findings in Citizens United. They argue, for instance, it was wrong for the court to say unlimited independent expenditures rarely cause corruption or the appearance of corruption.

And other critics of the Citizens United decision who believe the court was wrong to grant corporations constitutional rights, have intervened and asked the court to reverse itself.

"There is a growing bipartisan consensus that Citizens United needs to be overturned, and Montana is leading the way," said Peter Schurman, spokesman for a group called Free Speech For People. "The Supreme Court has an opportunity to revisit Citizens United here. That is important because there is evidence everywhere that unlimited spending in our elections creates both corruption and the appearance for corruption."

On Friday, Montana's case was given a boost when U.S. Sens. John McCain, R-Ariz., and Sheldon Whitehouse, D-D-R.I., signed on in support. The senators argue evidence following the Citizens United decision, where millions in unregulated money has poured into presidential elections, shows that large independent expenditures can lead to corruption.

The states who filed the brief in support of Montana are New York, Arkansas, California, Connecticut, Delaware, Hawaii, Idaho, Illinois, Iowa, Kentucky, Maryland, Massachusetts, Minnesota, Mississippi, Nevada, New Mexico, North Carolina, Rhode Island, Utah, Vermont, Washington, West Virginia and the District of Columbia.

When we think of time as money, leisure activities fall flat

We commonly treat time as a commodity. Or at least we have since Benjamin Franklin said that ?time is money.? Even so, thinking of time in terms of money keeps us from sitting back and enjoying it, according to new research in the Journal of Experimental Social Psychology. Sanford DeVoe and Julian House of the University of Toronto gave subjects a short time to listen to music or putter around on the Internet. The subjects enjoyed their leisure time much less if they had first been asked to calculate their hourly wage at work. This effect resulted from increased impatience, as indicated by a short follow-up survey. If you start equating time with money, you get itchy about any time not spent earning cash. Better to think of time as priceless, at least while on break.

France's new Socialist govt gets down to work

PARIS (AP) ? New French President Francois Hollande and his Socialist government adopted a 30 percent pay cut Thursday, a gesture of shared sacrifice by leaders who must now reduce the country's massive debts and tackle spiraling unemployment.

The new Cabinet's first meeting, just a week after conservative former leader Nicolas Sarkozy last convened his government, marked a sharp shift in France's power structure and strategy for solving Europe's debt crisis and restructuring the economy.

The new finance minister reduced hopes in some other European capitals that Hollande would ease off on his push for a renegotiation of a hard-won European treaty on trimming budgets.

"The treaty will not be ratified as is. It must be added to, completed with a growth amendment," Pierre Moscovici said after taking control of the Finance Ministry.

Hollande, elected May 6, has said the treaty focuses too much on spending cuts that are stifling growth and making the debt crisis worse, and argued for stimulus spending as well. He and the leaders of Germany, Britain, Italy and the European Union will hold a conference call later Thursday to discuss Europe's economic strategy ahead of the Group of Eight summit in the United States.

Hollande promised during his campaign to protect France's elaborate social benefit system ? even vowing to roll back some of Sarkozy's cuts ? while also continuing to trim the country's deficit. France hasn't balanced a budget in nearly 40 years, and Hollande has promised to eliminate the deficit in 2017.

It will be a difficult balancing act for the Socialists, who are taking power in the middle of a global economic slowdown and Europe's debt crisis. France's GDP did not grow in the first quarter of the year. Economists say growth will require deep reform to France's inflexible labor market ? and it's unclear if Hollande is willing to take that on.

"A country that is indebted is a country that grows poorer," Moscovici said on BFM television on Thursday. "But responsibility and growth are not mutually exclusive."

Ministers leaving the Cabinet meeting said the government started by adopting a 30 percent pay cut and signing an ethics charter to spend less money on travel and on their ministries.

But as a series of handovers of power took place Thursday, the emphasis seemed to be more on fulfilling campaign promises to enhance or at least protect benefits than on cutting spending.

Employment Minister Michel Sapin said his major challenge would be reducing unemployment that has reached 10 percent and allowing people who started working at a young age to retire earlier than a law passed under Sarkozy currently allows them to. Sarkozy faced down unions and strikes to push the retirement age to 62 from 60, saying it was the only way to save the system.

"We need to as quickly as possible put an end to the flagrant injustice put in place by the previous government," said Sapin. "What's on the agenda is to ensure the sustainability of our social benefit system that will allow retirees to live."

The new government will also confront major international questions, like Hollande's promise to withdraw troops by the end of the year from Afghanistan.

Defense Minister Jean-Yves Le Drian, an old friend of Hollande's, and Foreign Minister Laurent Fabius, a former prime minister, will surely wade into that debate, which will be raised at a NATO summit this weekend in Chicago.

Many NATO partners are unhappy with Hollande's decision. France had previously committed to keeping troops in the country until 2013 ? already faster than the alliance's timetable.

Hollande leaves Thursday night for Washington for a meeting with President Barack Obama, then attends the G-8 and NATO summits.

?Not men! Not beasts! THINGS!!!!?

Criterion have already released this wonderful film on Region A Blu-ray (and that has been reviewed previously), but now it is the turn of Eureka who should take a bow for delivering us the long-awaited and previously so hard to obtain 1932 horror classic, Paramount's Island Of Lost Souls from director Erle C. Kenton for the UK market. This is the first official home video edition that has been unveiled on these shores and this, alone, is cause for celebration.

Inarguably the best adaptation of H.G. Wells' seminal work of anti-vivisectionist fantasy The Island Of Dr. Moreau (first published in 1896), this was also the sort of film that shocked a generation, broke almost all the known taboos and gained notoriety by getting itself banned outright in twelve countries. Island of Lost Souls has now seen two hi-def editions come ashore. I have reviewed the excellent Criterion region A version already, and most of what I said for that applies to this region B transfer, which carries a similar AVC encode for the 1.33:1 (actually 1.37:1) image. Having compared the two, I can say that the differences are absolutely minimal, with the same specks and nicks, lines, fades and damage occurring in the same places and at the same times, and the level of detail supplied in the same quantity, clarity and resolution.

However, what I will also say is that this Eureka transfer is slightly brighter than the Criterion, and this can actually make you think that you are seeing a touch more information in the frame, with the darker areas of the US disc now lightened a touch and allowing more texture and potential detail to poke through. But this is marginal, at best, and there are those, myself included, who might prefer the more atmospherically darker, and better contrasted image that is seen on the American edition. Moreover, the Criterion transfer appears, to my eyes anyway, to have a deeper, denser layer of grain. The UK disc, in comparison, actually seems a little smoother at times, with the level of grain lessened. Again, when looking at the two images, I found that, personally, I preferred the Criterion in this regard.

Anyway, since the two are so similar in every other way, here?s what I said previously.

The transfer has been culled from the best possible sources ? including a damaged 35mm fine-grain master positive, the UCLA's 35mm nitrate positive and, to help repair some shots and sequences, a 16mm private screening print. Although you could never in a million years claim that the resulting image looks ?great?, there can be no disputing the fact that this is the best it is probably ever likely to look.

The vintage print has been cleaned up of myriad scratches, nicks, rips and pops, but there still exists plenty of age-related wear 'n' tear, as you would only expect for a film from 1932 ? and one that has also been the recipient of a multitude of cuts and existed in many differing versions. Contrast cannot help but waver, but this is not exactly a distraction, and when you see how deep and generally stable the black levels are, and how nicely refined the shadow-play, it would be churlish to complain about a few glitzy white-outs, some haziness and the odd indistinct background object. The blacks may well have been strengthened from the flimsy, mottled-grey veils that I've seen plagued earlier incarnations, but they don't eclipse any visual information that lurks within. The film looks nicely balanced, on the whole. Light and dark sit well, and the fall-off to grey is handled smoothly.

Detail remains good, although you have to appreciate the shape of the print. The image has a fair degree of depth, especially evident during the jungle sequences, and this is where the detail seems at its most luxuriant, with foliage, rocks, tents and vines, and long, snaking tree branches filling the frame. The Beast-Men, who crop up from all angles and from behind every shred of cover, are brought to rewarding life with the transfer's evident delight in their frightening visages. I have seen the impressive make-up from Wally Westmore in crystal clear, pin-sharp stills in books, and it would be unfair to compare them to the moving frames from this restored film, but there is plenty of texture and detail in the facial moulds and collagen, and we can see some finite separation in the applied hair and fur, and in the rather ghastly dentistry.

There is some occasional discolouration. I noticed a yellowish band forming a curved lid over the shot at one point but, again, this was only a small incident and, just like all the other anomalies, part and parcel of a film print (or prints) derived from 1932. Grain does tend to fluctuate and shift, but it doesn't appear at all artificial. There are no problems with edge enhancement either.

With only the check disc and a page of PR bumf, I have no details about how Eureka?s transfer was fully processed, or the equipment and techniques utilised, but I assume it has gone through pretty much the same process as Criterion?s. They have clearly taken pride in the restoration and presentation of Lost Souls and, once again, the final result gives me great optimism that all those cherished Universal horrors and RKO chillers will gain something similar in terms of their eventual hi-def makeover.

The final score naturally reflects the condition of the source and how well the transfer has been applied. It doesn't, of course, equate to the transfer of a more modern film.

Although I prefer the Criterion image, the differences are tiny and adhere to a more personal taste, therefore the technical marks remain the same.

Once again, you have to remember the source material that this transfer has been taken from ? which is from pure antiquity. So don?t go expecting miracles.

Eurekasupply Kenton's film with a DTS-HD MA 2.0 mix that is certainly up to the task of presenting the audio as cleanly and crisply as possible without anything unwanted being added to spruce up and, inevitably, cheapen the deal.

There are no major problems with the dialogue. It comes through just fine with only the briefest instances when it is masked or semi-swallowed by damage. Slightly tinny, as you would expect, but speech is almost always clearly intelligible and the many nuances of Laughton's delivery, the queer, semi-goth-queen intonations of Lota, and particularly the snarling Hungarian tongue-rolling of Lugosi's Sayer of the Law are quite finely reproduced. Certainly the gibbering howls and yowls of the poor wretch strapped to Moreau's operating table in the House of Pain lash themselves out of the mix with unearthly and horrid immediacy, and speaking of lashes, the mad doctor's bullwhip cracks away with style.

Naturally, there is some degree of hiss that rises up on occasion, but this proves no detriment to the experience, and possibly only adds to the vintage mystique of the drama. There?s no score to speak of, just opening and closing pieces during the titles ? with the end credits accompanied by a crazily upbeat flapper-dance! ? but this comes over with agreeable panache. Strictly speaking, I think it would be unrealistic to expect anything better than this. So far, I can only comment on the UK check disc from Eureka. The full release edition comes with a DVD copy of the film and a booklet with rare images from the film, plus there is a steelbook variant as well.

But as far as on-disc supplements go, this UK edition doesn?t fare as well as the Criterion. In fact, besides the Theatrical Trailer we only get two interviews that go into overview and opinion of the production and the film?s lasting legacy. Both are nice to see, but they lack the fun and detail that Criterion was able to delve into, and it would have been awesome to have both sets of extras combined to provide the full roster of freakish goodies.

The first interview is with actor/director/writer Simon Callow, who is an absolute devotee to, and historian of, Charles Laughton. Having written a biography on this incredible and immortal personality, he knows a thing or two about the choices the actor made, the things that influenced him and the attitude he had towards his performances. Callow provided excellent insight on the man for supplements on Criterion?s awesome BD of Night of the Hunter, but this 12-minute feature is much looser and less vital, somehow. There?s good information provided but this seems too light for the subject matter and the performance, itself, and Callow does end up rambling and his points become quite wayward.

The second interview is with horror historian Jonathan Rigby and runs for 15-minutes. Although this concentrates on the film, itself, the times and social mores of the cinemagoers and the Hollywood trends in which it debuted, and the whole Wellsian genesis, this is pretty deep and thoughtful without coming across as condescending. Rigby makes the connection between this and the earlier outrage of Tod Browning?s Freaks as well as all those pulpish jungle flicks that proliferated at this time and the inherent sense of the exotic and the mysterious, and, overall, this is a fine, though all-too-brief study of such taboo-shredding imagination.

Both men are filmed artfully (though rather pretentiously) in black and white, and the interviews feature clips and illustrations and stills to punctuate them.

It?s good that something was provided for this outstanding motion picture, but I was still left unsatisfied. For its 80th Anniversary, I?m surprised that more material wasn?t found, and that other critics and authorities weren?t involved. The Criterion edition wins hands-down in this department.

Verdict

Right, this is easy. If you can?t play the region A Criterion release, then this Eureka region B is obviously the way to go. The transfer is pretty much identical ? just the brightness being slightly more advantageous than its darker colonial counterpart ? and there are a couple of interesting supplements. But, if you can make the choice between the two regions, then the US disc is definitely the way to go, mainly because the extras are better, but I still think the transfer suits the coarser texture of the grain and the deeper shadows.

Either way, Island of Lost Souls is a true milestone in genre cinema that should not be overlooked. It is one of the greats, folks ? a landmark horror film that rocked the establishment during the medium?s Golden Age and proudly proclaimed that the genre had something powerful and emotive to say. After James Whale's Frankenstein ushered-in protests of blasphemy and Browning?s Freaks shocked sexual sensibilities and notions of descrimination, Kenton's picture for Paramount Studios, who were determined to add sex and terror to their roster, roiled in yet more infamy. With Laughton's sinisterly decadent cad claiming that he felt ?like God!? as he busied himself in the House of Pain, obsessively reshaping nature into grotesque parodies of itself, a stranded Richard Arlen getting the hots for the Panther Woman, and the Beast-Mens' libidos going molten when Leila Hyman's blonde bombshell gatecrashes the party, H.G. Wells' classic novel of anti-vivisection got a cinema patrons a little sticky under the collar. Even now, the film muddies morals and beckons to the beast in you.

Ineptly remade not once, but twice, it is time to go back to the original and the best adaptation of The Island Of Dr. Moreau ? and Eureka?s loving release makes that entirely possible and extremely worthwhile. Laughton camps it up with arrogant villainy, but he eats up the screen, and Wally Westmore's elaborate and memorable make-up design is given a tremendous showcase. The highly influential movie gets a fantastic transfer, all things considered, and a gem that has been hidden away for far too long now sparkles with twisted, infernal vigour.

Maria's 'DWTS' boot was no surprise to pro

Some fans were surprised to see Maria Menounos and Derek Hough get the ballroom boot on Tuesday night, but it wasn't exactly a shock to Hough.

It was a shocker for many ballroom fans to see Maria Menounos, who received a chart-topping 59 (out of 60) points on Monday night's "Dancing With the Stars," sent home just before the finals. But that?s just what happened.

Who wasn?t surprised? Menounos? own partner Derek Hough.

"I had a feeling," he told Today.com shortly after the ouster. "(Monday) night was so much fun. I almost felt like, 'OK. That was it.'"

In fact, both Menounos and Hough were ready for the elimination play out the way it did.

"I had a real sense of calm (on Tuesday)," Menounos admitted. "I said, 'Whatever happens will happen.' I?m going to be good. But yes, Derek told me, ?Babe, I think we?re getting eliminated.? I was like, 'Really?' He said, 'Yeah.' I said, 'OK. I?m going to prepare.'"

Hough, a three-time winner of "DWTS," felt that it was his duty to help prepare his partner. He also feels that it?s better to either come in first place or fourth in the competition. Now, he and Menounos won?t have to prepare for next week?s dances, which include an all-out freestyle routine.

"The finals are really stressful," he noted. "It?s harder to be that close (to winning it all) than this close (where we come in fourth.) We literally had not had a bad dance. I felt like Monday night was Maria?s night. She kicked butt and got five 10s from the judges."

After Katherine Jenkins was injured at the conclusion of her second dance on Monday's performance show, Menounos dispatched her medical team to Jenkins. "Later, my team came up to me and said, 'Maria, we took care of (Katherine), but we shouldn?t do that anymore. She?s your competition.' I said, 'Guys! This isn?t the Olympics. She?s my friend. Go take care of her!'"

While Menounos and Hough now leave the finals to Jenkins, Donald Driver and William Levy and their pro partners, it won?t be long before "DWTS" fans see the eliminated pair again. The duo, along with all the other ejected pairs from this season, will return for next week?s finale and perform one last routine.

"That?s what is so great about (leaving just before the finals)," Hough pointed out. "You go the whole season long. You have a couple of days break and then you come back for the finale and you do one more dance!"

Sectarian violence in Lebanon echoing Syria's conflict

The past three days have witnessed fierce sectarian fighting in Tripoli, Lebanon's second city, where tensions have been exacerbated by Syria's yearlong crisis.

?Although clashes are not uncommon here, the past three days have witnessed some of the fiercest fighting between Sunnis and Alawites in Tripoli in years, killing eight people, including a Lebanese soldier, and wounding more than 50. Mortar rounds were used for the first time, spurring hundreds of panicked people to leave their homes.

?We will not have peace here until we get rid of the Syrian regime. All our problems, all the violence, all the poverty we suffer here are because of the Syrian regime,? says Sheikh Bilal Masri, a militant Sunni cleric, talking over the crackle of a walkie talkie on his coffee table.

The thin, wiry preacher, who follows the austere Salafi sect of Sunni Islam, says he has not slept for three days and suffers from a persistent cough which he blames on smoke inhalation from burning tires and explosive residue. He picks up an old rifle fitted with a telescopic sight and pats the wooden stock affectionately.

??I shot two of them with this,? he says, handing over the French sniper rifle dating from the late 1940s.

A few hours earlier, he and other Sunni militants had been manning a frontline of bullet-holed, fire-scorched buildings and barricades of car tires while taking pot shots at his enemies hidden among the tower blocks in the adjacent hilltop district of Jabal Mohsen, home to Lebanon?s small population of Alawites, an obscure splinter sect of Shiite Islam.

?The Sunnis of Tripoli broadly support the mainly Sunni opposition in Syria. But the residents of Jabal Mohsen are members of the same minority Alawite sect which forms the backbone of the regime of Syrian President Bashar al-Assad.

On the main street in Bab Tebbaneh at the foot of Jabal Mohsen hill, Lebanese special-forces troops hunched over heavy machine guns mounted on armored personnel carriers or humvees. Other soldiers rebuilt fortifications for small outposts damaged in the fighting. A pipe severed by bullets sent a spray of water into the air. The street was filled with garbage, broken glass, and rubble from exploding rocket-propelled grenades.

One Sunni resident ruefully examined his black BMW, which was riddled with bullet holes, the windows shot out. Others cast cautious glances at the apartment blocks of Jabal Mohsen towering above, from where snipers still continued to send the occasional round cracking overhead.

The Alawites in Tripoli blame the resumption of violence on the Sunnis living in the neighborhoods that surround their isolated hilltop stronghold.

?We are few, they are many. Why would we want to pick a fight with them?? asks the bodyguard to an Alawite leader.

The fighting was sparked on Saturday evening by the arrest of Shadi Mawlawi, a suspected Islamic militant, who was later charged along with five other people for contacting an unspecified ?terrorist group.? Islamists in Tripoli demonstrated against Mr. Mawlawi?s arrest and blockaded the city center. When the protesters marched toward an office of a pro-Syrian political faction, the Army intervened. Shots were fired and shortly afterward, clashes broke out between Bab Tebbaneh and Jabal Mohsen neighborhoods.

A resumption of violence between the two districts is widely expected.

?The guns are ready and the people are ready,? said one young man standing beside a barricade.

Local politicians scrambled to curb the violence in Tripoli amid deteriorating security along most of Lebanon?s northern border with Syria.

?Lebanon is at the edge of a volcano,? Najib Mikati, the Lebanese prime minister, warned Tuesday.

Army opens jobs in combat battalions to women

FORT CAMPBELL, Ky. (AP) ? Female soldiers this week are moving into new jobs in once all-male units as the Army breaks down formal barriers in recognition of what's already gone on in wars in Iraq and Afghanistan.

The policy change announced earlier this year is being tested at nine brigades, including one at Fort Campbell, before going Army-wide. It opens thousands of jobs to female soldiers by loosening restrictions meant to keep them away from the battlefield, after the experience on the ground in the past decade showed women were fighting and dying alongside male soldiers anyway.

Col. Val Keaveny Jr., commander of the 4th Brigade Combat Team that is among units piloting the change, told The Associated Press that for the last decade it has been common to have women temporarily attached to the combat units and serve alongside them.

"Women have served in our Army since the Revolutionary War and they have done phenomenal work and continue to do so today. There is great talent and now we can have it in the headquarters of infantry, armor and cavalry," he said.

Under the new policy, female officers and non-commissioned officers will be assigned to combat units below the brigade level. The change will open up about 14,000 new jobs for women in the military, but there are still more than 250,000 jobs that remain closed to women.

The new jobs within combat battalions are in personnel, intelligence, logistics, signal corps, medical and chaplaincy. The Army is also opening jobs that were once entirely closed to women, such as mechanics for tanks and artillery and rocket launcher crew members.

The 4th Brigade draws its lineage from the 506th Parachute Infantry Regiment, whose World War II heroics led to books and a TV miniseries called the "Band of Brothers." But these days, Keaveny said there are more than 350 women already serving in the brigade and they will be opening 36 new jobs to women in the battalions.

"For the last 10 years, we have been fighting alongside women. In my experience I have seen that the Band of Brothers quickly integrate their sisters and they are a family," he said.

Capt. Elizabeth Evans, a 44-year-old mother of five, is one of the first women assigned to the combat battalions. She will be serving as a battalion S1, whose job is to oversee personnel issues within the battalion, including awards, casualties, human resources and other administrative responsibilities. She said there is a lot of pride associated with serving in an infantry unit.

"I think there's a rich history in the 101st and especially the 4th Brigade Combat Team," she said. "To me that means something. It means something to be a part of not necessarily history, but to be a part of a once all-male battalion."

Evans, who has deployed to Afghanistan, noted that women have been serving in dangerous jobs in Iraq and Afghanistan for 10 years.

"With the fluidity of the battlefield and how there are no front lines, it just makes more sense to me to allow women to come into those roles, those noncombat staff roles," she said.

Keaveny said these changes will have minimum impact on where women will be located while deployed. Battalion headquarters are generally located at bases where women were already stationed and the Army has been using female engagement teams to reach out to civilians in remote areas.

"Quite honestly we don't see there's going to be any friction," he said.

Kayla Williams, author of "Love My Rifle More Than You: Young and Female in the US Army," served with the 3rd Brigade Combat Team under the 101st Airborne Division during the initial invasion into Iraq as an enlisted soldier in military intelligence.

Early in the war, she wasn't even issued plates for her ballistic vest "because females can't serve in combat," she said. She said she was once attached to an infantry battalion that had no female latrines.

As an Arabic translator, she was attached to infantry units rather than assigned, but doing the same things as her male infantry counterparts, including going on foot patrols and living in remote combat outposts.

"Women have been serving in very forward deployed roles, and women have been serving side-by-side with combat arms personnel, just not in a formalized assigned method," said Williams, who is a fellow at the Truman National Security Project.

She said these incremental changes could improve the professional development of both men and women in the military, but acknowledged that the military still has a long way to go to leveling the field for women.

"It is my personal opinion that the institutionalization of women as not being able to serve in combat arms has a way of subtly allowing sexism within the military," she said.

Evans said she hopes the expanded roles will encourage more women to consider a career in the Army.

"I think for females in general, it's bringing us new avenues for accomplishments, for professional growth. In my personal belief, we are a part of supporting our infantryman," she said.

Business Ethics. A Sad Tale of an Immigration Consultant Firm in ...

As most of you know, our blog posts are usually about Canada and US immigration visas, our clients? victories and sometimes defeats. But this one is a little different. It is about what I consider the sad state of our industry when it comes to business ethics?among?immigration law firms and consultant firms.? Business Ethics. And I have a personal incident to share.

I have been practicing immigration law for over 15 years and I can say I think I have seen it all. Over the years I am proud to say I have developed a lot of close friendships with fellow immigration lawyers and consultants with whom I have collaborated and shared ideas. I am of the?belief? that ?sharing is caring?.

It?s a big market out there and the old ways of hoarding information for fear of competition is really shooting?yourself?in the foot. My approach has always been to take a more open,?collaborative?approach. I certainly don?t know everything and learning things from my colleagues helps me with my practice?tremendously?it?s always a give and take.

So this leads me to a sad story about one particular immigration consultancy firm based in Toronto that will remain nameless.?This particular firm I have dealt with for many years. The CEO I considered as a personal friend who I respected a lot. Like me, he appeared to take open approach to sharing ideas. He also was big on ethics?so I thought. His firm has done well over the years and offers a unique brand of services online. I have told him that despite that our firms? websites are one of the most well-trafficked. ?I never saw him as a competitor. Rather, I respected what he had done and the feeling was mutual it seemed.

And as such, I made it my business to stay away from offering his unique areas of service while he did the same with me.

But that was then and this is now?.

One day, he introduced his IT guy to me. This character, who will also remain nameless, had particular knowledge in VoiP phone technology which I was exploring at the time. In any case, this IT guy got to know my staff, and without a doubt in my mind, he actively?recruited one of my staff members for the CEO of the referring firm! Whether he was instructed to do so, I will never know.

In any case, the employee in question left my firm as a result and ?joined the CEO?s organization. Ok it happens. We get a lot of employees from other firms as well. (But we never poach). ?But there is more. The CEO, after I reached out to him, admitted that this employee of mine did in fact join his firm and he admitted that the way it was handled was totally wrong and he?apologized. He said that this sort of thing would not happen again; that we are friends and he was sorry.

So given our long standing?relationship, I did not hesitate to accept his?apology?and chalked it up to an isolated incident and all was forgotten. But that was then and this is now??..

Over 6 months later, another employee of mine, who shall remain nameless, fell ill. She went though some personal issues and took a medical leave. She was my employee for many years. I treated her like family and paid her a very healthy salary way above what the?industry?commands. I was happy to do it because she was very loyal and dedicated for many years at my firm.

What happened is that my former employee, the first one mentioned, got wind of the second employee?s leave of absence. They knew each other. And what happened next is in a word:?unconscionable. She reached out to the second employee and attempted to recruit her to the CEOs firm! Apparently, the second employee and the CEO met and a job was offered. Shocking.

Learning of this, in disbelief, I reached out to the CEO who very sheepishly admitted that ?Yes he had met up with this person. And I have every right to be upset and that he would feel even worse than I would if it happened to him?. He told me that he would have a ?meeting with his staff the next morning and work it out?. He would then contact me later on in the day with an ?update?. Well it turned out that nothing of substance took place at this meeting as all I got from him was: ?Michael, going forward we will not?solicit?any of your staff. It is wrong.?

Going forward? Was he joking? Does he really want to go down this route?

The?disturbing?thing is that over the years, this guy loved to talk about business ethics: comments like ?what goes around comes around?. ?Its not all about the money? . The cliches were endless.

I do wish the second employee all the best. She is a great person. And sometimes it?s time to move on. Again our employees always have reasons for staying and leaving.

But back to our CEO. ?I told him via email that in essence, all was not forgiven this time. And given what now seems to be a pattern of poaching, we were no longer collaborators but competitors. Sad really because I built my business based on collaboration?whether it be with my staff,?colleagues?and other?professionals. What the CEO did tell me that ?what goes around comes around? is something I believe, even if he really doesn?t.

The lesson I think is that in business even when there are?opportunities?which seem tempting, if they come across your desk that, in the end, will impact your?reputation?with your?colleagues, clients and friends, perhaps it?s best to think twice. There are always?opportunities?but friends and collaborators do not come by often. Its just big picture thinking.

The Atlantic: A recent Pew Hispanic Center report highlights the rather steep declines in the number of Mexicans coming to the United States, as well as the rising numbers leaving for Mexico. Taken together, they show that net migration from 2005 to 2010 reached zero--with inflows and outflows of some 1.4 million individuals (a rough average of 280,000 a year) cancelling each other out. This is a huge migratory shift, and one that reflects many things, including a weaker U.S. economy, a stronger Mexican economy, changing Mexican demographics, rising deportations, and enhanced border security.

Another migratory change has also occurred: of the Mexicans that still come to the United States, many more do so legally. At the start of the twenty-first century, less than 10 percent came with papers. A decade later, it is 50 percent.

The vast majority of these came on "family reunification visas"--spouses, parents, children, or siblings of U.S. citizens or legal permanent residents. Others--some ninety thousand in 2011--came on H-visas to work, their professions ranging from engineers to agricultural workers. Ten thousand more came to study. Some two thousand--more than double 2000 levels--came on E-2 NAFTA visas, reserved for investors and business people from countries that are U.S. trading partners. Mexicans also received their highest ever number of EB-5 visas, which require a $500,000 to $1 million investment in a U.S. business, and the creation of at least ten U.S. jobs.

The rise in legal immigration has the potential to alter the political debate, as it lessens the law and order challenges. But some will still be concerned about the role of this large group of immigrants, believing as the late Harvard professor Samuel P. Huntington did, that Mexican immigrants "threaten to divide the United States into two peoples, two cultures, and two languages." Perhaps a final trend can help allay these worries. Panasonic racks up a record loss for 2012, looks forward to profits and a partner for OLED TVs

Panasonic's yearly earnings are in and the red ink added up to a record $9.7 billion net loss for 2011. Number one on incoming president Kazuhiro Tsuga's list is turning around the company's TV division, where its heavy investments in both plasma and LCD manufacturing resulted in heavy losses. Currently the company expects a better result in both next year after 2011's write downs and restructuring, although its projections see total sales falling from 17.3 million last year to 15.5 million. Panasonic is expected to follow Samsung and LG into large screen OLED HDTV production and outgoing prez Fumio Ohtsubo mentioned it would likely look for a partner there. Sumitomo has been rumored as a potential ally in the past, though a preference for run-flat tires could not be confirmed at press time.
